Welcome to Bar Rank. By acknowledging and accepting these Terms of Services you are agreeing to be bound by the same. Please read them carefully.

All Bar Rank participants must be at least twenty-one (21) years of age. By acknowledging and accepting these Terms and Conditions you are affirming that you are at least twenty-one (21) years of age.

1. What Bar Rank Is

Bar Rank is a loyalty and competition platform operated by Bar Rank LLC (a North Dakota limited liability company). It allows customers at participating bars to earn points by playing games, compete on a live leaderboard, and win prizes set by the bar. Bar Rank is provided as a service to participating bars — the bar owner is responsible for their prizes, promotions, customer relationships, and ensuring compliance with these Terms of Service. Bar Rank LLC is not responsible for the acts or omissions of participating bars.

2. Your Information And Consent

When you check in you provide your name and mobile phone number. By checking in you explicitly consent to:

• Collection and storage of your name and phone number as described in our Privacy Policy
• Your name or nickname appearing on the live leaderboard displayed in the bar
• Receipt of SMS messages from the bar you checked into via Bar Rank
• Optional GPS location capture at the moment of check-in for presence verification

We record the timestamp and source of your consent. You may withdraw consent at any time by requesting account deletion at BarRank.LLC@gmail.com.

We do not sell your information to third parties. Your phone number is used only as your account identifier and for SMS communication. Full details are in our Privacy Policy.

3. Location Data

When you check in, Bar Rank requests access to your device's GPS location through your browser. This is used solely to verify that you are physically present at the participating bar at the time of check-in. Location data is stored securely and is only accessible to Bar Rank staff and the bar owner for the purpose of platform integrity. Location permission is optional — check-in works whether or not you grant it.

We do not track your location outside of the check-in event. Location is only captured at the moment you tap Check In.

4. Leaderboard Display

By checking in you consent to your name or nickname appearing on the live leaderboard displayed in the bar and on the Bar Rank platform. If you prefer not to have your full name shown, you may enter a nickname at check-in. Your name will not be shared publicly beyond the in-bar leaderboard display and the Bar Rank platform.

5. SMS Messages

By checking in you consent to receive occasional SMS messages from the bar you checked into, sent via Bar Rank. These messages may include competition updates, special promotions, and event announcements. Bar Rank complies with applicable Telephone Consumer Protection Act requirements for SMS communication.

Message and data rates may apply. You can opt out at any time by replying STOP to any message. After opting out you will not receive further messages from that bar via Bar Rank.

6. Points And Prizes

Points are awarded for gameplay activity as described in the app. Points have no cash value, are not transferable, and cannot be redeemed for cash under any circumstances.

All prizes are set by the participating bar owner. The bar owner is solely responsible for prize fulfillment, availability, and delivery. Bar Rank LLC makes no express or implied warranties or representations regarding prizes and is not responsible for prize fulfillment by bar owners.

Points and prizes are subject to the rules of the specific competition at each bar. Bar owners may modify competition rules, prizes, and point values at any time. Bar Rank reserves the right to void points or disqualify participants in cases of suspected abuse, cheating, or technical error.

Competitions run on Bar Rank are games of skill, not games of chance. No in-platform purchase is required to participate. Points are earned through gameplay activity at the bar.

7. Fair Play And Anti-cheat

You agree to use Bar Rank honestly and in good faith. The following are prohibited:

• Sharing QR codes with people outside the bar
• Using multiple accounts or phone numbers to earn additional points
• Coordinating with others to artificially inflate scores
• Using technical means (browser tools, scripts, API calls) to manipulate points or game state
• Scanning QR codes without being physically present at the bar
• Any other conduct intended to circumvent the fair operation of the competition

Violations may result in point removal, account suspension, or permanent removal from the platform at Bar Rank's sole discretion. Bar Rank uses GPS verification, scan pattern analysis, and admin review to detect and address abuse.

8. Nickname Conduct

If you choose a nickname, it must be appropriate and inoffensive. Bar Rank and participating bar owners reserve the right to remove or replace nicknames that contain profanity, slurs, hate speech, or otherwise offensive content without notice.

9. Account Deletion

You may request deletion of your account and all associated personal data at any time by emailing BarRank.LLC@gmail.com with the subject "Data Deletion Request" and the phone number associated with your account. Deletion will be completed within 30 days. Deleting your account forfeits any unclaimed prizes and removes you from all leaderboards.

10. Security

Bar Rank, in accordance with applicable law, uses industry-standard security measures to protect your data including encrypted connections and restricted database access. You agree not to attempt to access, probe, or test the security of Bar Rank systems without express written authorization from Bar Rank LLC.

11. Limitation Of Liability

Bar Rank is provided as-is without warranty of any kind. Bar Rank LLC makes no express or implied promises, warranties, or representations concerning operation of the Bar Rank platform or the administration of competitions and prizes. Bar Rank LLC is not liable for any loss of points due to technical issues, bar closures, or changes to the competition by the bar owner. Bar Rank LLC disclaims all liability to you for any claim arising from use of the platform, except to the extent such claims arise from Bar Rank LLC's gross negligence or willful misconduct. This limitation applies to the fullest extent permitted by applicable law.

12. Governing Law

These terms are governed by the laws of the State of North Dakota. Any disputes arising from these terms or your use of Bar Rank shall be resolved in the courts of Cass County, North Dakota.

13. Changes To These Terms

Bar Rank LLC may update these terms from time to time. Bar Rank LLC will post updated terms at this URL with a new effective date. For significant changes Bar Rank LLC will attempt to notify users via SMS. Continued use of Bar Rank after changes constitutes acceptance of the updated terms.
